XCEED FACEBOOK SWEEPSTAKES OFFICIAL PRIZE ENTRY RULES:
1. NO PURCHASE NECESSARY TO ENTER OR WIN. 2. The Xceed Facebook Sweepstakes begins March 1, 2010 and ends March 31, 2010 (“Facebook Sweepstakes Period”). To enter automatically: An eligible member automatically receives one Sweepstakes entry by 1) visiting our Xceed Financial Credit Union business page on Facebook, 2) becoming a "fan" of Numbers Guy by March 31, 2010, and 3) leaving a message on our wall that says, “Hi, NG!” To enter without obligation: print your name, address, city, state, zip code, phone number, and the words “Xceed Facebook Sweepstakes Prize Entry” on a 3”x5” postcard and mail it to: Xceed Financial Credit Union, 888 North Nash Street, El Segundo, CA 90245, Attn: Marketing. If an entry form is drawn, but judges are unable to determine the winner because of illegible writing, that entry form will be disqualified. One entry without obligation is allowed per member within the Sweepstakes period. Entries become the property of Xceed Financial Credit Union and will not be returned. 3. Drawings: There will be five (5) random drawings for the Sweepstakes at the Xceed Marketing Department. Entries must be received by Xceed by midnight March 31, 2010 PST to be eligible for the Sweepstakes. All eligible entries will be entered into the prize drawing, which will by held on or about April 1, 2010. Winners will by notified by Facebook and by phone. 4. Prizes: Five (5) Sweepstakes Prizes will be awarded. Prize is $100. The actual odds of winning depend on the number of eligible entries received. 5. Prize restrictions: Winner cannot substitute, assign, or transfer prizes except at the sole discretion of Xceed. Any portion of the prize not accepted by the winner will be forfeited. Prize details not specifically set forth herein are at Xceed’s sole discretion. Xceed reserves the right to substitute a prize of equal or greater value should the featured prize become unavailable. 6. Xcced associates, officials, and members of their immediate families are not eligible to participate. To qualify for the Sweepstakes, entrant must be a legal resident of the United States, at least 18 years of age as of March 1, 2010, and a member in good standing of Xceed Financial Credit Union. 7. By entering into the Sweepstakes, Entrants agree to abide by and be bound by these Official Rules and to accept the decisions of Xceed as final. Sweepstakes void where prohibited by law. Entrants also agree to hold Xceed and each of its officers, directors, associates, members and representatives and agents harmless from any liability arising from participation, or the acceptance, receipt, possession, or misuse of the prize. Xceed and each of its officers, directors, associates, members, and representatives, and agents are not responsible for any negligence, claims, liability, injury, property loss, or other damages of Entrants and/or winners arising from, or in connection with, acceptance, receipt, possession, or use/misuse of prizes awarded or participation in this Sweepstakes. Xceed is not responsible for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due mail or entries; or for entries lost due to any reason. Xceed reserves the right to disqualify Entrants who fail to follow these Official Rules or who make any misrepresentations relative to the Sweepstakes and prize redemption. 8. Xceed will report all prize winnings to the appropriate state and Federal agencies as required by applicable law. Winners are responsible for all other associated costs in connection with the prize, including tax consequences (if any). Each winner agrees to permit Xceed to use his/her name and likeness in promotional and other Credit Union materials, without additional compensation or permission, except where prohibited by law. 9. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrant and Xceed in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA, without regard to choice of law rules. 10. Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that (1) any and all disputes and causes of action arising out or connected with this Sweepstakes or any prizes awarded, shall resolved individually, without resort to any form of class action, and exclusively, by final and binding arbitration under the rules of the American Arbitration Association and shall be held at the AAA regional office nearest the participant; (2) the Financial Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other that Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased. 11. Xceed Financial Credit Union is the sponsor of this Sweepstakes and is headquartered at 888 North Nash Street, El Segundo, CA 90245.
